Independent Executives
This visa was developed in recognition that an emerging number of Independent Executive visa holders in Australia were facing expiry of their visa, but were legitimately in Australia and required time to be eligible to apply for permanent residence under the:
- Established Business in Australia (Subclass 845)
- Regional Established Business in Australia (Subclass 846)
- State/Territory Sponsored Business Owner (residence) (Subclass 892)
Who is this visa for?
This visa is only for existing holders of a Temporary Business (Long Stay) Independent Executive visa who need more time to be eligible to apply for one of the visas listed above.
New applicants for subclass 457 visas should apply for a Temporary Business (Long Stay) - Standard Business Sponsorship.
What does this visa let me do?
This visa allows you to:
- remain in Australia to continue business activities as an owner
- leave and re-enter Australia as long as the visa is valid
If you are a Temporary Business (Long Stay) Independent Executive visa (Subclass 457IE) holder in Australia and are facing expiry of your visa, this visa allows you more time to become eligible to apply for the following permanent residence visas:
- Established Business in Australia visa
- Regional Established Business in Australia visa
- State/Territory Sponsored Business Owner (residence) visa.
Visa validity period
This visa is valid for two years.
Bringing family
The following people may be included in your application:
- your partner
- your or your partner's dependent children
- other dependent relatives living with you.
With this visa you are unable to access Medicare, the Australian Government medical expenses and hospital care scheme.
Eligibility
Main Applicant Eligibility
Time in Business
You must have conducted a business in Australia for at least 15 months as a principal. Exception: If less than 15 months you must have received an endorsement of the business as beneficial to a State or Territory from a relevant State/Territory Government business development agency.
Business activity
Your business must be of benefit to Australia.
Ownership interest
You must maintain an ownership interest in the business.
Management role
You must maintain direct and continuous involvement in the management of the business.
You must also make decisions that affect the overall direction and performance of the business from day to day.
Background
Your background must be relevant to and consistent with proposed business activity and the department knows of nothing adverse about your business background.
Net assets
You must have net assets of A$250,000 or a lesser approved amount, and the assets must be available to conduct or establish the business.
Presence in Australia
You must have a need to be temporarily resident to conduct the business.
Your family members must meet the following requirements to be eligible for this visa. Evidence of each of the requirements with your application.
You can include the following people in the application for this visa.
- your partner
- your or your partner's dependent children
- other dependent relatives living with you.
Adding family to your application
If your child is born after you lodge your application the child can be added to your application, once you notify the department of the details of the newborn child.
You can also request in writing for a dependent child to be added to your application.
Your partner can apply separately for this visa as long as your visa has not yet been granted.
Health requirement
All family members must meet health requirements to enter Australia.
Character requirement
All family members must be of good character for you to enter Australia.
